Dear Madam: In reply to your recent communication relative to billboards and advertising on highways in this state, I am enclosing herewith a copy of Section 10 of Act 19 of the Public Acts of 1919 of the State of Michigan. Signs ami guide*-post a. Penally for removal, etc. Yours very truly. Sec. 10. It shall lie the duty of the State Highway Commissioner to cause all State trunk line highway routes to he distinctly marked by signs and fvsde posts of a uniform .'esign as may he deemed necessary for the public convenience and necessity. Any person who shall remove, deface, injure or destroy any such sign or guide post, or who shall place along any such highway any marker, guide or warning sign without the approval of the State Highway Commissioner shall be deemed guilty of a misdemeanor and shall upon conviction be liable to a fine of not more than one hundred dollars, or be imprisoned in the county jail not exceeding thirty days, or to both such fine and imprisonment in the discretion of the court. The State Highway Commissioner shall cause to be removed all signs, markers or guide posts that have not been duly authorized. Any person causing such markers, signs or guide posts to be unlawfully placed along a State trunk line highway, or who injures, defaces or removes any sign, marker or guide post properly placed by the State Highway Commissioner, or with his approval, shall be liable for the expenses occasioned by such unlawful or improper act. An action of assumpsit to recover such expense may be brought by the State Highway Commissioner in any court of competent jurisdiction; and any moneys recovered shall be paid into the treasury of the State and shall he there credited to the State highway funds. The cost of placing suitable markers, signs and guide posts hereunder shall he deemed to be a part of the construction, improvement and maintenance of the road and shall be paid for accordingly.
